Appeal Court upholds IPOB as terrorist organisation

The Nigerian Court of Appeal has upheld the judgement of the lower court which earlier outlawed activities of the Indigenous People of Biafra, IPOB, and declared it as a terrorist organization.

The IPOB organization however, rejected the ruling and appealed to the Court of Appeal seeking the judgement to be quashed, but on Thursday at the Appealate Court in Abuja, the Justice Hamma Barka, ruled that he found no basis for the judgement of the lower Court to be set aside, hence, the IPOB remain a terrorist organization.

The court also said the Federal Government did not violate any law in proscribing IPOB, citing that activities of IPOB constituted a national security threat to the peaceful existence of Nigeria.
Lawyer to the IPOB, Chukwuma Machukwu Umeh has in the aftermath of the Federal High Court challenged the judgment at the Court of Appeal, urging the set aside of the judgement.
Machukwu averred misrepresentation and suppression in the affidavit by the former Attorney-General and Mnister of Justice, Abubakar Malami before the Court.
The lawyer claimed that over 30 million Igbo people are members of the Indigenous People of Biafra, supporting agitation to secede and all of them cannot be declared as terrorists as the Federal Government of Nigeria was trying present.
In a unanimous judgement on Thursday, the three-member panel of the appellate Court faulted the claim by Chukwuma Machukwu Umeh that the procedure adopted by the Federal Government in proscribing IPOB was flawed.
They held that the Federal government fully complied with the provisions of the relevant laws, particularly section 2 (1) of the Terrorism (Prevention) Act by adopting the ex-parte proceedings.
He said: “Such ex-parte proceedings, unless tainted, does not constitute any breach of the right to fair hearing of parties before the court.”
Justice Barka adopted the position of the Supreme Court in the case of Dokubo Asari against the Federal Republic of Nigeria to the effect that where national security is threatened or there is the likelihood of it being threatened, human rights or individual rights or those responsible takes a second place. “Human rights or individual rights must be suspended until national security can be protected or well taken care of. This is not anything new.
“The corporate existence of Nigeria as a united, harmonious, indivisible and indissoluble sovereign nation is certainly greater than any citizen’s liberty or rights,
“While the security of this nation is in jeopardy, and it survives in pieces rather than in peace, individual’s liberty or rights cannot exist.”
Justice Barka said there is no doubt that IPOB, based on its activities, was infiltrated by hoodlums, operating and surviving on mayhem, which is worrisome and quite evident to all well meaning Nigerians.
According to him, since IPOB has been linked to violence, the Federal Government cannot take the blame for proscribing the group and designating it a terrorist organisation.
The appellate court also also said there were evidence that then President Muhammadu Buhari gave approval for the then Attorney General of the Federation (AGF), Abubakar Malami (SAN) to apply to the court got the proscription order in compliance with section 2(1) of the Terrorism (Prevention) Act.
Recall that former Chief Judge of the Federal High Court, Justice Abdul Abdu-Kafarati, had in a ruling he delivered on September 15, 2017, outlawed operation of IPOB in Nigeria.
The proscription order followed an ex-parte motion the former Attorney-General of Federation and Minister of Justice, Mister Abubakar Malami, filed on behalf of the Federal Government.
Justice Kafafati outlawed all activities of IPOB, particularly in the South-east and South-South regions of the country as illegal.
He also barred any person or group of persons from participating in any of the group’s activities.
He also directed the AGF to publish the proscription order in the official gazette, as well as in two national newspapers.

Delta women give Senate President 14-day ultimatum to apologize to Senator Natasha

A group called the Virtuous Women of Delta (VWD) has given the President of the Senate, Senator Godswill Akpabio, a 14-day ultimatum to tender an unreserved apology to Mrs. Natasha Akpoti-Uduaghan.

The group made the demand in a statement issued on Tuesday and signed by its Coordinator, Deaconess Eguolo Oghenekevwe.

In the statement, the group expressed their outrage over Akpabio’s alleged disrespectful behavior towards Mrs. Akpoti-Uduaghan, describing his actions as sacrilegious according to Delta’s cultural traditions.
The statement read, “We have patiently watched as the Senate President has dragged our sister through the mud. In our tradition, such actions are considered sacrilegious and carry severe consequences.”
The group further emphasized their disapproval of Akpabio’s behavior, particularly his decision to have Mrs. Akpoti-Uduaghan removed from a public space, which they found deeply disrespectful.
“The fact that he had our wife walk out of a public place is enough to make us march to the National Assembly in protest,” they stated.
The group gave Akpabio 14 days to issue an unreserved apology, warning that if he fails to do so, they will be compelled to take action and express their anger in person at the National Assembly.
The controversy stems from previous comments Akpabio made, including the use of inappropriate language referring to a nightclub, despite the fact that Natasha Akpoti-Uduaghan is married to a prominent Delta man.
Akpabio had earlier apologized for his remarks, acknowledging their sacrilegious nature.
“Such words are unacceptable, especially when a married woman is involved. Our men are like lions and will not tolerate such disrespect,” the statement continued.
The Virtuous Women of Delta emphasized that, as Akpabio hails from the same geopolitical zone, he should be aware of the importance of their cultural values and traditions, which cannot be disregarded.
“We politely ask the Senate President to apologize, or face the consequences within the next 14 days,” the group said.

Stakeholders storm NASS, throw weight behind creation of Hadejia State

Stakeholders from Jigawa State, including elders, opinion moulders, royal fathers, and legislators on Tuesday stormed the National Assembly to throw weight behind the proposed creation of Hadejia State.

The Chairman of the Movement for the creation of Hadejia State, Malam Musa Shu’aibu, while presenting the historical perspective of the struggle, stated that the demand was born out of the people’s desire to take their destiny into their hands.

He explained that the conquest of the Hadejia Emirate in 1906 and the introduction of the provincial system of administration in 1926 led to a gradual loss of identity and the capacity to harness local resources for development. Despite being the second largest emirate in size, economy, and population under the provincial system when Kano and Jigawa existed together, Hadejia did not receive commensurate development in relation to its contribution to the Gross Domestic Product (GDP).
Hadejia, derived from the River Hadejia, supports the livelihoods of a large segment of the population. Based on the 2006 census, the proposed state’s population was 1,245,571, with almost equal numbers of male and female inhabitants. The current projected population is 1,811,185.
The proposed state is made up of eight local government areas, three federal constituencies, and nine state assembly constituencies, all from the Jigawa North East Senatorial District.
According to Malam Shu’aibu, the region is highly endowed with vast land, water bodies, animals, and fertile soil for farming, but these resources have not been fully harnessed.
“If granted the state, we the people of Hadejia know our land more than anyone else, and we will do everything possible to harness our resources for the benefit of our people. We believe we can even make a greater contribution to the Nigerian nation,” he stated.
He drew a comparative example with Bayelsa State, which was created in 1996 with six local governments, while Hadejia’s request with six local governments at that time was not granted. Today, Bayelsa has eight local governments and remained a state, while Hadejia now has eight local governments and is still seeking state creation.
The delegation was led to the Senate for the presentation of the memorandum by Senator Ahmed Abdulhamid Malam Madori, representing Jigawa North East Zone.
The group expressed optimism that their request would receive positive consideration, emphasizing the potential of the proposed state to thrive independently.
