Abuja based foremost Prophet and founder of ‘Divine Hand of God Prophetic Ministries’, Dr. Emmanuel Omale has sued the First City Monument Bank (FCMB), claiming the sum of N5 billion damages for the financial institution’s negligence in its fiduciary relationship with him.
In the writ of summon issued by the Federal High Court in Abuja at the instance of the claimant viz: Divine Hand of God Prophetic Ministry, Dr. Emmanuel Omale, Pastor Mrs Deborah Omale vs First of Monument Bank, which was deposed on 4th of September, 2020, the defendant was ordered to enter in the lawsuit within 30 days.
The writ warned the financial institution of default, stating that, it risked judgement against it, if it fails to appear within the stipulated time given.
CAPITAL POST earlier reports that the Founder of Divine Hand of God Prophetic Ministry, Emmanuel Omale was investigated by Justice Ayo Salami led Presidential panel investigating the former Acting Chairman of the Economic and Financial Crimes Commission, Ibrahim Magu in an allegation that Magu paid the sum of N573,228,040.41 million into his Church account. An allegation, Omale denied.
The Managing Director of First City Monument Bank, Adam Nuru, however, absolved the clergy of any wrongdoing when he was interrogated by the panel on transactions involving the account number of the Ministry, claiming that the controversial amount of money was erroneously transferred.
The bank insisted that the error occurred when the accounting software of the FCMB was being upgraded.
However, in the legal twist, the lead Counsel to the claimant, Chief Gordy Uche (SAN) averred in the memorandum to be subscribed in the writ that the defendant had breached its fiduciary duty of care, hence, the claimant is seeking a remedy of N5 billion.
Part of the claimant’s claim against the defendant states: “a declaration that the defendant negligently breached the fiduciary duty of care it owes the claimant by its false automated report to the Nigerian Financially Intelligence Unit (NFIU) of a suspicious credit inflow of N573,288,040.41 into the claimant’s corporate current account number 1486743019 with FCMB.
“That the sum of N5 billion being exemplary, aggravated, special and general damages against the defendant for the negligence breach of fiduciary duty of care be effected by the Court.”
