Facebook poster, Mohammed arraigns in court, risk N5 million penalty for alledged ‘hate speech’ against Niger governor, wife

Operatives of the Special Intelligent Bureau of the Niger State Police Command, (SIB), has arraigned one Abubakar Sadiq Mohammed before a chief Magistrate Court Angwan Daji Minna, for posting an injurious comments on his Facebook page against the governor of Niger State Abubakar Sani Bello, and his wife Dr. Amina Abubakar Sani Bello.

The operatives of the undercover police, alledged that Abubakar Sadiq of the Etsu Nupe palace in Bida Niger State used the social media platform known as ” Nupe Industrial Group Facebook Account” through his phone to mischievously post an insulting or abusive language against the person of the Executive Governor of Niger State, Dr Abubakar Sani Bello which read as follows: “Breaking News, Governor of Niger State Abulolo is dead”

According to the First Information Report (FIR), made available in court and obtained by the CAPITAL POST, states: “That again on the 22nd October 2019,” You Abubakar Sadiq Mohammed of the same address still used the same social media platform to post further insulting and defamatory words as follows: “Seriously our Niger State Governor is the number one wicked governor among the 36 States we are having in Nigeria.

“That again, you used the same Facebook page on the 27 August, 2019, to defame and insult the wife of the governor of Niger State, Dr. Amina Abubakar Sani Bello as follows: “Dear Mrs Governor, you are more terrible than “Boko Haram”.

“Again, that you posted on the same social media platform that please Nigelites, let pray towards the impeachment of Abulolo.

“That you still further posted on the same platform that:. “My state Governor is so heartless than Boko Haram among other defamatory postings against the person of the Governor and his wife.”

Police investigation, according to the charges revealed that, “You Abubakar Sadiq Mohammed made the above defamatory words knowing same to be false and with intent to injure the good name and reputation of the governor of Niger State and his wife to cause breach of public peace in the state.

“During police investigation, you confessed to the commission of the said crime.”

The accused was arraigned on three count charges which contravened sections 392, 393(1), and 399 of the penal code law.

When the charges were read to him by the presiding Chief Magistrate, Hajiya Fati Takuma, the accused admitted making the posts against the person of the Niger State Governor, but denied that he did not make any against his wife.

At this point the police proscuting officer, Inspector Mu’azu Abdullahi told the court that investigation into the matter is yet to be completed and asked the court to remand him in correctional custody pending the completion of police investigation.

Chief Magistrate Fati Takuma then remanded him in the Minna Correctional Centre and adjougned the case to the 17th of August, 2020 for further mention.
