PAAU Management suffers defeat as Court strikes out motion against Alumni Association with a cost
The High Court of Justice sitting in Anyigba has struck out the motion on notice of a preliminary objection raised by the Management of Prince Abubakar Audu University Anyigba against the Alumni Association for lack of merit.
In a ruling on suit no AYHC/03/23 by the court on Thursday the 12th of October 2023 at Anyigba , the presiding Judge , Justice Ajayi did not only strike out the preliminary objection but awarded a cost of #20.000 as damages in favor the Association.
During the sitting the counsel to the defendant Akobe Esq argued that a new date be given to the defence counsel to come up with a proper argument or withdrawl the motion.
But counsel to the plantiff , Shuaibu Ibrahim Esq said that the defendants were not delligent in prosecution of their motion and requested the court to strike out the motion with a cost
Justice Ajayi in his ruling struck out the motion of preliminary objection and awarded a cost in favour of the alumni.
The case was however adjourned to 14th of November for further hearing.
