A Minna Senior Magistrate court No. 7 sitting at the High court complex has sentenced a 26 years old Mohammed Umar to a total of 15 months in custodial home for being in possession of some dried weed suspected to be india hemp.
He was arraigned in court by men of the X-squard of the Niger State Police command on a four count charge bordering on criminal intimidation, resisting lawful arrest, intentional insult and having possession of dry leaves suspected to be india hemp.
According to the police prosecutor, Inspector Aliyu Yakub, the four count charges were punishable under section 397, 172 399 of the penal code and 5 (1b) of indiahemp act 2004 respectively.
He told the court further on the 6th of July 2021, at about ” 1400hrs one ASP Abubakar Abdullahi attached to Lemu Divisional command reported that on 1st July, while on patrol along Sabongida village, in Bida Minna road, he caught you Mohammed Umar of Sabongida village in possession of some dried leaves suspected to be indiahemp.”
As he made efforts to arrest you, you resisted lawful arrest and in the process you brought out Cutlass and threatened to kill him if he fails to give the dried leaves he recovered from you.
During further investigation, more of the weeds suspected to be india hemp and the said Cutlass were recovered from your possession and you confessed to the crime”.
When the charges were read to him by the presiding Senior Magistrate Hajiya Fatima Kabir, he pleaded guilty to the four count charges and the prosecutor requested the court to convict him in accordance to section 157 of the criminal procedure code, (CPC),
she then sentenced him to a total of 15 months on the four count charges with N50,000 fine option.
