Niger: Munya LG Chairman, Daza, escapes being jailed for contempt of Court
Justice Mohammed Adishetu Mohammed of Minna High Court number four, has sound a strong warning to the Chairman of Munya Local Government Area of Niger State, Mohammed Garba Daza to desist from disobeying court order and the constituted authority or else he will end up in jail.
Justice Mohammed Adishetu Mohammed who gave the warning when the chairman was brought to the court by the men of the state criminal investigation and intelligent Department (SCIID), warned that “no body is above the law no matter your position in the society.
“For you to refuse to comply with court order and you think you can do that and go away with it. For the last time, don’t ever refuse to comply with court order no matter what the is a court of law and you have to obey the order of the court.
“This should be the first and the last warning to you.
“Any other time you refuse any court order from this court honestly you will be committed to Correctional custody for contempt”, Justice Mohammed warned.
The chairman has been having a legal legal battle over his refusal to swear in two councilors who won their election at November 30, 2019 Local Government election in Niger State.
In the earlier judgement delivered on the 22nd June 2019 by Justice Mohammed Mohammed against the Chairman, he nullified the illegal and unconstitutional swearing in of Erick Dangaladima as the Councillor of Kazzai ward of Munya Local Government.
He then ordered the Chairman to swear in Attahiru Adamu within 24 hours of the judgement which he refused to comply with the series of the court judgement.
Similarly, Justice Balikisu Gambo Yusuf of Minna High court number 5 has on Monday, the 29th June, 2020 delivered a judgement against Mohammed Garba Daza ordering him to swear in another Councillor Sule Yahaya of Dagunu Ward of Munya local Government area.
The Chairman for the second time in the judgement obtained against him was ignored in compliance with the judgement to swear in the two Councillors without any recourse.
However, Barrister Musa Suleiman, Counsel to the two Councillors, in an interview with CAPITAL POST disclosed that he will approve Justice Balikisu Gambo Yusuf of the Minna High court number 5 to compel the Chairman to swear in Sule Yahaya of Dagunu Ward without further delay.
The then Chairman apologize to Justice Mohammed Adishetu Mohammed for his unruly behavior and his refusal to comply with the court judgement, promising that he will be of good conduct to all court order henceforth.
